Fundació Mobile World Capital Barcelona Foundation (hereinafter “MWCB”) is a Spanish public foundation, with registered offices in Barcelona, at Roc Boronat, 117, 08018, registered at the Registre de Fundacions of the Generalitat de Catalunya with number 2.717 and with tax identification number G65.760.431.
MWCB tries to develop through the Mobile World Capital Barcelona a new industrial sector around mobility, with the aim of transforming Barcelona into the world´s leading mobile city, offering high value-added services and technology clusters.
Through our website www.4yfn.com (hereinafter the “Site”) we make accessible to the public relevant news, information, initiatives and events organised by MWCB relating to the startup business platform named 4YFN (4 Years From Now).
1. USE CONDITIONS
1.1 By using our Site you get a user status (hereinafter the “User”).
1.2 We may modify the Terms or the Policies at any time and it is your responsibility to check their content. Please review the Terms and Policies regularly to ensure that you are aware of any changes or updates made. Using the Site means that you agree to be legally bound by the current and amended versions of the Terms and Policies. In case of disparity between prior versions of the Terms and/or Policies and their updated versions, the latter shall prevail.

We reserve the right to bar any such activity or material; or (viii) to use any portion of the Site, by any means, to link to an internal or subsidiary page of the Site that is placed one or several levels down from the home page (deep linking) or to present Content of the Site within another website (framing).
2. CONTENTS DISCLAIMER
2.1 We maintain this Site to enhance public access to information, news and events relating to the Mobile World Capital initiatives. Our goal is to keep all the content of the Site timely and accurate. If errors on the content of the Site are brought to our attention, we will try to correct them as quickly as possible. However, we accept no responsibility or liability whatsoever with regards to the accuracy of the content published on the Site.
2.2 We reserve the right to revise or delete any contents of the Site, as well as limit or deny the access to any User either temporarily or permanently.
Notwithstanding the above, this disclaimer is not intended to limit our liability in contravention of any requirements laid down in applicable national law or to exclude our liability for matters which may not be excluded under that law.
3. USE OF THE SITE CONTENT
3.1 All the content published in the Site, including without limitation to copyrights, rights similar or related to copyrights or to the sui generis right over databases, patents, utility models, industrial designs, graphics, source code, texts, pictures, photographs, trademarks, trade names, logos, slogans, domain names, social profiles, interfaces, music and/or audiovisual works, trade secrets and know-how, whether registered, applied for or not registered (hereinafter, the “Contents”), are owned or licensed by MWCB and protected by all applicable industrial and intellectual property law, including unfair competition laws.
3.2 Unless otherwise specified in the IP Policy, Users are not allowed, by any means, to reproduce, distribute, transform or communicate the Content to the public. Even if expressly authorised, any use of the Content must comply with the IP Policy, the Terms and all related and applicable Polices.
3.3 The Site may provide links to independent and external third party websites (hereinafter, “Third Party’ Sites”). The Site includes these links to give Users the opportunity to access other websites that may be of their interest. Third Party Sites are out of our control and we do not assume any responsibility about the content provided by Third Party Sites. 4. PUBLISHING CONTENT ON THE SITE
4.1 If you upload or otherwise submit content to the Site, you agree to grant MWCB a free worldwide license to reproduce, distribute, modify and communicate to the public such content.
4.2 MWCB does not accept or consider any unsolicited ideas, original creative work, suggestions or other work, including ideas for new advertising, campaigns, new promotions, new or improved products or technologies, processes, materials, marketing plans or new product names, among others, sent to MWCB or its employees through the Site, per e-mail or by any other means. The aim of this general policy is only to avoid potential misunderstandings or disputes when MWCB products or marketing strategies seem similar to submitted ideas. We will automatically disregard any unsolicited material sent to MWCB
6.1 MWCB is not obliged by any means to run the site or to provide the content hosted in the site. Both, the hosting of the site and the provision of content may be cancelled, suspended or temporarily suspended at any time without previous notice. MWCB does not warrant either the site or the contents to be free of errors, defects, viruses, or to be provided without interruptions. 1. PURPOSE OF STORING DATA
1.1 The data collected via the Site’s contact forms to receive specific information or replies to questions made to the MWCB (the “Contact Forms”) and the newsletter form to receive general information periodically (the “Newsletter Form”) will be included in the above mentioned personal data filing system. In these terms, the storage of your data fulfills the main purpose of recording your query and being able to offer you a suitable response and also improve the services we offer. This filing system fulfills the statutory requirements laid down in the LOPD, and also the technical requirements and organizational measures set forth in the Royal Decree 1720/2007, of December 21, that implements the LOPD, in order to safeguard the security of the data you provide.
1.2 The data collected via the Site’s blog will also be included in the abovementioned personal data filing system. In these terms, the storage of your data fulfills the main purpose of recording your comments on said blog and making it visible to the other Site users.
1.3 When providing your data on the Contact Forms, on the Newsletter Forms or posting a comment via the blog, you are giving your consent to the storage of your data in our filing systems. All the data marked with an asterisk on the form must be completed for your query to be submitted. We do not request any information that is deemed specially protected data under the legislation in force, or any type of economic data.
1.4 Your personal data will be processed by MWCB to:

2. SUPPLEMENTARY INFORMATION

4. USER RIGHTS
4.1 You may have access to the data stored on our filing systems at any time, and may rectify, cancel or object to that data (“ARCO Rights”). You may exercise your rights by sending an e-mail to firstname.lastname@example.org or a letter to: Fundació Mobile World Capital Barcelona Foundation, Roc Boronat, 117, 08018, Barcelona, Spain. In all cases you must prove your identity with a photocopy of your valid ID document or passport in order to exercise your ARCO Rights. These rights have the following rules:
(i) You may request and obtain free of charge information about your processed personal data, their origin (which in our case will always be the questionnaires on the Site) and communications that may affect that data.
(ii) The MWCB is released from any liability in the event that the request to be shown or have data corrected is made from the e-mail address included on the query form and that the above-mentioned ID documents are included, since in such an event it is the data subject who will be deemed to be making the query.
(iii) You may request the rectification or cancellation of your data, which will be carried out by the MWCB within ten (10) days. Cancellation entails that your data will be blocked and stored only in case they are requested by the public authorities or judges and courts.
4.2 The MWCB accepts its liability and warrants that it will comply with the duty of secrecy incumbent on it in relation to all the data supplied.
5. DISCLOSURE OF DATA
– GSMA, Ltd., located at 1000 Abernathy Rd NE# 450, Atlanta, GA, United States of America for the purpose of managing and organising the Mobile World Congress;
– Zoho Corporation, located at 4141 Hacienda Drive Pleasanton, CA 94588 United States of America; and Zoho Corporation Private Limited, Estancia IT Park Pvt Ltd. Plot No 140 & 151, GST Road, Vallancherry Village, Chengalpatty Taluk, Kanchipuram Distric 603 202 (India) which provides us with an indispensable tool for the purpose of customer relationship management (CRM).
5.2 For other purposes, the MWCB warrants that the data provided will not be accessible by any person unrelated to the MWCB and that they will only be shown at the request of a properly evidenced data subject.
6. END OF THE PROCESSING
If, for any reason, the MWCB ultimately stops providing its services through the Site, it will destroy all the stored data in order to maintain the security of the data supplied and will bring them into line with their purpose.
8. APPLICABLE LEGISLATION AND JURISDICTON
1.1 MWCB has launched this blog platform (hereinafter the “Blog”) to provide Users with a common and honest space where people around the world can exchange their ideas and opinions about our core topic: the “Mobile World Capital Barcelona” and its activities.
1.2 To keep an enjoyable environment for all Users, MWCB asks you to attend this Blogging Policy, please read it carefully before accessing the Blog. MWCB may modify this Blogging Policy at any time so it is your responsibility to review it regularly to ensure that you are aware of and you agree with any changes. Posting on the Blog means that you agree to be legally bound by the current Blogging Policy and by any subsequent or amended version, and that you fully recognize your responsibility for your own comments.
1.3 MWCB has the right but is not obliged to publish your comments. MWCB reserves the right not to publish or to remove comments which:
(i) Are defamatory, libelous, false, misleading, unfounded or unproved; insulting, threatening or abusive, obscene, sexually explicit, racist, offensive, provocative, sexist, homophobic, discriminatory or otherwise objectionable. EMAIL NEWSLETTER POLICY
YOU AUTHORIZE MWCB to use your personal data in order to send newsletters with information on activities and events and activities organized by MWCB or in which it participates, and information related to mobility, these communications being sent to you by any means, including email.
You AUTHORIZE, by completing the 4 Years From Now (4YFN) activities registration form:
a) The incorporation of the personal information you provide during the registration process to a file managed by the Fundació Barcelona Mobile World Capital Foundation (MWCB), with registered offices at Roc Boronat, 117, 08018 Barcelona, Spain. The file is called “Contacts” and is duly registered with the General Register of the Agencia Española de Protección de Datos. You can exercise your rights of access, rectification, cancellation and opposition before MWCB by writing a letter sent to MWCB or by sending an email to firstname.lastname@example.org, enclosing a copy of a valid ID or passport for identification purposes.
b) That MWCB or third parties acting on its behalf can capture your image (which rights you warrant to be the holder) and/or voice, reproduce it and/or display it, in whole or in part, in a visual, video-graphic, photographic or paper support, among others, and use it for promotional purposes related to the promotion and diffusion of MWCB activities, through any method or medium MWCB deems appropriate, all of the foregoing without geographical, temporary or any other limitation. The authorisation hereby granted by you is free of charge.
c) The transfer of personal data to GSMA Ltd., an entity with domiciles in 1000 Abernathy Road NE, Suite 450, Atlanta, GA 30328 USA, organiser of the Mobile World Congress to be held in Barcelona from 27 February-1 March 2017, an event to which you will be granted access, subject to conditions, as participant registered for the 4YFN event.
TICKETS GENERAL CONDITIONS
The sale of tickets for events and activities organised by 4YFN takes place in authorised websites and purchasing them through these portals implies the acceptance of the general conditions.
1. VENUE ACCESS
To get into the site you will have to show your ticket that will be scanned in order to check it. You will have to show your ID card or passport if the organization requires you to.
1.1 To get into 4YFN events, your ticket will be exchanged for a personal and non-transferable badge. You will not be able to enter the site if you lose or damage them. Check our web for information on time and places exchange.
1.2 The Organisation may deny entrance to the sites to any ticket holder in the following circumstances:
1.2.1 Tickets are amended, broken or shown with falsification hints.
1.2.2 The ticket holder is violent or publicly incites hate, violence for reasons of birth, race, sex, religion, opinion, handicap, sexual orientation, gender or any other social or personal condition or circumstance. Especially any ticket holder who behaves in an aggressive manner or provokes disturbances outside or at the entrance to the Event, one who carries weapons or any object which could be used as one and anyone who wears clothes, objects or symbols that incite violence or defend activities contrary to the fundamental rights stipulated in the Constitution.
2. PURCHASE PROCEDURE ON THE PORTAL:
2.1 Before starting the purchasing procedure it is necessary to have registered your personal data on the registration form or to be logged in.
2.2 Once you have a log in and password you can proceed with the purchase of tickets. You will be able to modify the ticket before accepting the purchase. Once you have accepted the order you have purchased the ticket.
3. TICKET GENERAL TERMS AND CONDITIONS:
The purchase of the 4YFN tickets implies the acceptance of the following conditions:
3.1 Return Policy
• Tickets may only be purchased at sales points and platforms specifically authorised by the organisers and after purchase, they will be not be changed and no refund will be given. Any tickets that are altered, torn, or that present signs of falsification will authorise the organisers to deny the bearer access to the event. Resale of tickets is forbidden. The organisation does not accept responsibility for the loss or theft of tickets.
• No changes or refunds are allowed except in case of cancellation of the event.
• Failure to attend an event, no-show or an error on the purchase are not grounds for its return.
• According to current regulations on consumer and retail management, the Purchaser may not exercise the right of withdrawal or resolution.
• In case of suspension of the event after the lapse of more than half of it, the Purchaser shall not be entitled to a refund of the ticket price.
• Bad weather is not a reason for refund.
• For any cancellation or change to occur in an Event MWCB agrees to send an email to the Purchaser at the address given on the registration form informing them of such cancellation or change.
• 4YFN/MWCB is not liable for loss or theft of tickets.
3.2 The organisation reserves the right to alter or modify the programme should an artist be unable to perform at the event for reasons beyond the control of the event. The event will look for a replacement artist whenever possible.
3.3 Children’s Attendance
• At 4YFN: Individuals under 16 years of age (including infants) are not permitted entry to the 4YFN venue during build-up or dismantling days. Requests for minors’ attendance during event days must be made to the event organisers, in writing, prior to the start of the event and approval is at the discretion of the organisers. Requests for exceptions cannot be made onsite. During event days, people under 16 years of age will only be admitted to the event if accompanied by an adult or legal guardian. The parents or guardians must ask the organisation and complete a letter of authorisation and liability for admittance of minors and carry it at all times. The event organisers reserve the right to request said letter of authorisation at any time.
The event organisers reserve the right to request the national identity card or passport proving the age of the person attending at the entrance to the venue, or inside it subsequently.
Under all circumstances individuals under 16 years are prohibited from consuming alcohol and tobacco.
• At Mobile World Congress: Individuals under 16 years of age (including infants) are not permitted entry to the Mobile World Congress venue during build-up, dismantling or on event days. Any exceptions to this policy are in the sole discretion of the organiser of Mobile World Congress and permission must be provided by the organiser, in writing, prior to start of the event. Requests for exceptions cannot be made onsite.
– The ticket-holder recognizes that he/she may appear on images taken on the event site by different media and that these may be used for informative or promotional purposes and that he/she authorises such use which will be the responsibility of the media concerned.
3.5 When you make the payment your details will automatically be provided to the bank and to the company that manages the payment by credit card and to the bank.
4. MWCB can cancel or modify any of the above conditions, and will inform the public of these changes by whatever channels they consider adequate.
5. MOBILE WORLD CONGRESS TERMS OF ACCESS
4YFN pass holders are invited to attend the GSMA Mobile World Congress on Thursday, 2 March 2017. By accepting that invitation and attending Mobile World Congress, the attendee understands and agrees to be bound by the Mobile World Congress Attendee Terms and Conditions, available at https://www.mobileworldcongress.com/terms-and-conditions/. To be granted access to Mobile World Congress, the attendee must meet all access requirements dictated by GSMA in its sole discretion.
